TERMS & CONDITIONS OF AGREEMENT
UK VISAS ONLINE'S DUTIES AND LIABILITIES
1. UK Visas Online shall have no duty or liability towards
the Client under the terms of this or any other agreement until it has received
from the Client all fees and costs due to UK Visas Online by the Client. Unless
otherwise expressly agreed between UK Visas Online and the Client in writing all
fees in respect of any product or service to be provided to the Client from UK
Visas Online shall be payable in advance.
2. UK Visas Online shall take all reasonable steps to
ensure that all documentation contained on its website and all advice and
assistance provided to the Client is sufficiently accurate and comprehensive to
enable the Client to make a complete and thorough application or appeal to the appropriate
UK immigration or other authority. UK Visas
Online makes no guarantee, express or implied, that any actual or proposed application
or appeal to
any UK immigration or other authority shall be successful.
UK Visas Online makes no representation, express or implied, that it acts
for or on behalf of the Client as the Client’s nominated representative in
respect of any such application or appeal unless the Client has purchased the UK Visas
Online Premier Service or UK Visas
Online Appeals Service. Where the Client has
purchased the UK Visas Online Basic Pack or Pack
PLUS UK Visas Online acts in an advisory capacity
only towards the Client unless otherwise expressly agreed in writing between the
Client and UK Visas Online.
3. UK Visas Online shall provide the Client with the
appropriate UK Visas Online Visa Pack requested by the Client upon
the Client's registration as a UK Visas Online Client and any further UK
Visas Online Visa Pack subsequently requested by the Client for the
Client's personal use during the period of 1 year commencing from the Client's
registration as a UK Visas Online Client.
UK Visas Online shall also respond to any reasonable request for
professional immigration advice from the Client for the Client's personal use
during the period of 1 year commencing from the Client's registration as a UK
Visas Online Client. Where the Client has
purchased the UK Visas Online Pack PLUS, UK Visas Online shall
also provide the Client with the appropriate cover letter to accompany the UK
Visa Application in respect of which the Client has purchased that Pack PLUS. Where the Client has purchased the UK Visas Online Premier Service, UK Visas Online shall also liase on the
Client's behalf with the appropriate UK immigration authorities in respect of
which the Client has purchased that Premier Service.
4. UK Visas Online shall ensure that all original and important documents sent by
UK Visas Online by post to the Client, the UK immigration authorities, the UK immigration appellate authorities or any other appropriate official body are sent by Royal Mail
first class recorded delivery or Royal Mail international recorded delivery unless otherwise expressly directed by the Client in which case the Client shall reimburse UK Visas Online for any additional expenses occasioned by using
such alternative mode of postal or courier service.
5. UK Visas Online shall ensure that at all material times
all UK Visas Online documentation contained on its website and all advice and
assistance provided to the Client pursuant to the purchase by the Client of a UK
Visas Online Pack carries independent professional indemnity
insurance.
6. UK Visas Online shall ensure that at all material times
its caseworkers are registered with the Office of the Immigration Services
Commissioner.
7. UK Visas Online shall not
incur any expenses on behalf of the Client without the prior written authority
of the Client nor shall UK Visas Online require any additional fee from the
Client in respect of advice and assistance provided to the Client in accordance
with UK Visas Online's duties and liabilities under the terms of this agreement
UNLESS the Client requests a consultation or attendance in person with a UK
Visas Online caseworker or authorised representative in which event UK Visas
Online shall usually require an additional fee from the Client in respect of
such personal consultation or attendance. Unless otherwise expressly agreed
between UK Visas Online and the Client in writing all fees in respect of such
personal consultation or attendance shall be charged at an hourly of not more
than £100 per hour payable immediately at the time of that attendance.
THE CLIENT'S DUTIES AND LIABILITIES
8. UK Visas Online makes every effort to ensure that all
questionnaires contained on its website and all correspondence directed to the
Client request all relevant information for the
purpose of completing the applicable UK Immigration Forms and any supporting
documentation, and that information provided by the Client when responding to any
UK Visas Online questionnaire or correspondence fully and accurately
reflect the Client's actual circumstances. However,
the final checking of any UK Immigration Form or other documentation completed
or prepared by UK Visas Online on
behalf of the Client shall always rest with the Client, who should inspect the
Forms or other documentation carefully before submitting them to the appropriate UK immigration
authority. If the Client identifies any errors contained in the Forms or other
documentation, or wishes
to make any amendments to the Forms or other documentation, UK Visas Online will, of course, rectify or
amend these as quickly as possible free of charge.
9. The Client warrants that all representations made in the
course of any communication with UK Visas Online, its servants or agents in
whatever form or media are
true to the best of the Client's knowledge and belief. In the event that the
Client knowingly misrepresents any matter relating to the proposed application
by the Client to the UK immigration authorities UK Visas Online shall be
entitled to treat any contract between itself and the Client as terminated.
In the event that UK Visas Online has reason to believe that the Client has knowingly
misrepresented any matter relating to the proposed application
by the Client to the UK immigration authorities UK Visas Online shall be
entitled to treat any contract between itself and the Client as terminated.
10. The Client warrants that he or she shall make no
representation, express or implied, that UK Visas Online acts for or on behalf
of the Client as the Client’s nominated representative in respect of any
actual or proposed application or appeal to any UK immigration authority: the Client acknowledges
that UK Visas Online acts in an advisory capacity only towards the Client unless
the Client has purchased the UK Visas Online Premier Service or UK Visas
Online Appeals Service unless otherwise expressly agreed in writing between the Client and UK Visas
Online in which case the Client acknowledges that UK Visas Online shall be
authorised to act as the Client's sole nominated representative in respect of
the Client's
actual or proposed application or appeal to any UK immigration authority.
11. The Client shall NOT provide UK Visas Online with
any original documentation of the Client's unless
otherwise expressly agreed in writing between the Client and UK Visas Online.
The Client shall bare all costs and liability in respect of any
documentation of the Client's provided to UK Visas Online unless
otherwise expressly agreed in writing between the Client and UK Visas Online.
COMPLAINTS PROCEDURE
12. Any complaint about any matter concerning any advice or
assistance provided to the Client by UK Visas Online must be directed in writing
to the Director of Casework, UK Visas Online, Head Office, 2 Sheraton Street, London W1F 8BH, United Kingdom, e-mail:
alexandra.kaleniuk@ukvisasonline.com, fax: +44 (0) 87 00 94 14 92. Acknowledgement of
receipt of any complaint shall be given to the Client normally within 48 hours
and a full written response to the complaint given normally within 7 working
days. The Client may complain at any time directly to the Office of the
Immigration Services Commissioner, an independent authority responsible for
regulating the provision of all immigration advice and assistance in the United
Kingdom, whose address is The Office of the Immigration Services Commissioner,

DATA PROTECTION
13. Personal data submitted by the Client to UK Visas
Online shall be used by UK Visas Online solely for the purpose of advising and
assisting the Client with his or her proposed application or appeal to the UK immigration
authorities and the Client agrees unconditionally that such data may be retained
and used by UK Visas Online for that sole purpose. The Client also agrees that
for the purposes of sending the Client requested documentation and advice, and
of processing the Client’s payment of any fees in respect of such
documentation and advice, the Client’s data may be transferred to offices
belonging to or associated with UK Visas Online which operate in countries
outside the European Economic Area. UK Visas Online shall, in the usual course
of its business, ensure that all Personal data of the Client other than the
Client’s name, date and country of birth and UK Visas Online membership
number, username and password is destroyed no more than 6 years after the expiry
of the Client’s UK Visas Online registration.
CANCELLATION
14. The Client shall have the right to cancel the contract
up to seven working days from the day after the conclusion of the contract by
e-mailing such a request to cancel the contract to either the UK Visas Online
caseworker dealing with the Client’s application or to that caseworker’s
supervisor. Alternatively the Client may direct such a request in writing
to the Director of Casework, UK Visas Online, Head Office, 2 Sheraton Street, London W1F 8BH, United Kingdom, e-mail:

GENERAL
15. None of the Client's statutory rights shall be
affected by any of these terms and conditions.
16. The laws of England and Wales in the United
Kingdom shall be the laws which govern all contractual dealings between the
Client and UK Visas Online.
